These Terms & Conditions govern the provision of services by Maintenance Etc ("Maintenance Etc", "we", "us", "our") to customers ("you", "your").
By requesting, booking or accepting services from Maintenance Etc, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions is intended to remove or restrict any statutory rights you have as a consumer.
1. About Maintenance Etc
Maintenance Etc provides home maintenance, handyman and related property services.
Our services are intended to help customers maintain safe, functional and comfortable homes and, where appropriate, support older people in maintaining their independence at home.

2. Our Services
Our services may include, but are not limited to:

general handyman services;

minor household repairs;
-
property maintenance;
-
checking and replacing batteries in smoke alarms where appropriate;

changing light bulbs;
-
minor repairs to doors, handles and fixtures;
-
fitting or replacing key safes;
-
gardening, weeding and general outdoor maintenance;
-
minor household adjustments;
-
general property checks;
-
other small maintenance tasks agreed with the customer.
The exact service provided will depend upon the customer's requirements and the nature and condition of the property.
We may decline work where we reasonably believe that the work:
-
is unsafe;
-
requires specialist qualifications or certification that we do not hold;
-
requires a specialist contractor;
-
is outside our normal service;
-
could cause significant damage to the property;
-
creates an unacceptable risk to our staff, contractors, customers or members of the public; or
-
would require us to undertake regulated or specialist work for which we are not appropriately qualified or authorised.
Where reasonably possible, we will explain why work cannot be undertaken and may recommend that you contact an appropriately qualified specialist.
3. Services We Do Not Provide
Unless expressly agreed in writing and where we are appropriately qualified and authorised, Maintenance Etc does not provide:

medical services;
-
nursing services;
-
personal care;
-
diagnosis or treatment;
-
electrical installation work requiring specialist certification;
-
gas installation or repair work;
-
structural engineering services;
-
major building works;
-
specialist roofing works;
-
asbestos removal;
-
specialist pest control;
-
other regulated or specialist services for which specialist qualifications or registration are required.
Where a job falls outside our competence, we may recommend that you use an appropriately qualified professional.
4. Quotations and Estimates
Where appropriate, we will provide a quotation or estimate before work begins.
A quotation will normally state:
-
the work to be carried out;
-
the price or pricing basis;
-
whether materials are included;
-
any relevant exclusions; and
-
any other important conditions.
Unless expressly stated to be a fixed quotation, an estimate is an indication of the expected cost and may change if circumstances discovered during the work differ materially from those originally anticipated.
Where additional work becomes necessary, we will normally discuss the additional work and cost with you before proceeding.
5. Pricing
Our current pricing is as stated on our website, quotation, booking confirmation or other written agreement.
Current standard charge: £50 per hour.
Any pricing information published on our website is subject to confirmation at the time of booking.
Prices for materials, replacement parts, specialist products, disposal, parking, additional labour or other expenses will be explained where reasonably possible before those costs are incurred.
We will not deliberately incur additional charges without appropriate authorisation.
6. Materials and Parts
Where materials or replacement parts are required, we may:

ask you to purchase them;
-
purchase them on your behalf; or
-
include them within an agreed quotation.
Where we purchase materials on your behalf, the cost may be added to the service charge.
Materials supplied by us will be reasonably suitable for the agreed work.
Where a manufacturer's warranty applies to a product, that warranty may be provided by the manufacturer rather than Maintenance Etc.
7. Booking Appointments
Appointments will normally be arranged by telephone, email, online enquiry or another agreed method.
We will aim to attend at the agreed date and time.
Appointment times may occasionally need to change because of:

emergencies;
-
illness;
-
traffic or travel disruption;
-
adverse weather;
-
unexpected delays at another property;
-
equipment failure;
-
circumstances affecting staff or contractors; or
-
other circumstances outside our reasonable control.
Where we need to change an appointment, we will make reasonable efforts to notify you as soon as possible.
8. Access to the Property
You are responsible for ensuring that Maintenance Etc can safely access the relevant property or area at the agreed time.
Where a relative, carer, friend, landlord, agent or other representative is arranging access on your behalf, you are responsible for ensuring that appropriate permission has been provided.
We will not knowingly enter a property without appropriate authority or permission.
Where keys, key safes or access codes are provided, they will be handled with reasonable care.
You should tell us about any known access restrictions, alarms, pets or other matters that may affect a visit.
9. Customers Who Are Older or May Require Additional Support
We recognise that some customers may be older, disabled or otherwise require additional time or support when arranging services.
We aim to provide services in a respectful, patient and professional manner.
Where appropriate, we may communicate with a family member or authorised representative.
However, we will respect the customer's privacy and wishes and will not disclose personal information to another person unless there is appropriate authority or another lawful basis for doing so.
10. Customer Responsibilities
Customers are expected to:

provide accurate information about the work required;
-
tell us about known hazards;
-
provide safe access to the property;
-
secure animals where reasonably necessary;
-
provide access to relevant areas;
-
obtain any permission that is the customer's responsibility;
-
provide accurate contact information;
-
pay agreed charges when due; and
-
treat our employees and representatives respectfully.
11. Health and Safety
We take reasonable steps to protect the health and safety of customers, employees, contractors and others affected by our work.
We may stop work if we identify a significant safety risk.
Examples may include:
-
unsafe electrical systems;
-
suspected gas leaks;
-
structural instability;
-
dangerous working-at-height conditions;
-
hazardous substances;
-
suspected asbestos;
-
aggressive animals;
-
unsafe access;
-
significant fire hazards; or
-
other circumstances presenting a serious risk.
Where necessary, we may recommend that an appropriately qualified professional or emergency service is contacted.
12. Electrical, Gas and Specialist Work
We will only undertake work that we consider ourselves competent and appropriately equipped to carry out.
Where work requires a specialist qualification, certification or registration, we may decline to carry out the work and recommend a suitably qualified contractor.
Customers should not assume that Maintenance Etc is authorised to undertake specialist regulated work merely because we provide general property maintenance services.
13. Standard of Service
We will provide our services with reasonable care and skill and in accordance with applicable consumer law.
Where a service is not carried out to the required standard, customers may have statutory rights concerning repeat performance, price reduction or other remedies depending on the circumstances.
Nothing in these Terms & Conditions limits rights that cannot legally be excluded.
14. Existing Damage and Hidden Defects
Properties may contain defects or conditions that are not reasonably apparent before work begins.
Examples include:

concealed pipes;
-
hidden electrical cables;
-
damaged plaster;
-
weakened timber;
-
hidden damp;
-
structural defects;
-
corrosion;
-
previous poor workmanship;
-
hidden leaks; or
-
other concealed conditions.
We will take reasonable care, but we cannot accept responsibility for damage caused solely by a pre-existing hidden defect that could not reasonably have been identified before the work.
If we discover an unexpected problem, we may stop work and discuss the available options with you.
15. Damage Caused During Work
We will take reasonable care when working at your property.
If you believe that Maintenance Etc has caused damage to your property, please notify us as soon as reasonably possible.
We will investigate the circumstances fairly.
Nothing in these Terms & Conditions excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or restricted.
16. Payment
Payment must be made using the payment method agreed when the service is booked or completed.
Payment methods may include:
-
bank transfer;
-
card payment;
-
cash where accepted; or
-
another payment method agreed by Maintenance Etc.
Payment terms: Payments to be made in full, the day of works completed.
Where an invoice is issued, the payment due date will be stated on the invoice.
We reserve the right to suspend future non-essential services where an undisputed invoice remains unpaid.

Customers may cancel or rearrange an appointment by contacting us as soon as possible.

Where a statutory cancellation right applies, that right will not be restricted by these Terms & Conditions.
For certain consumer contracts entered into at a distance or away from business premises, statutory cancellation rights may apply. Specific rules can also apply where a customer asks a service to begin during a cancellation period.

18. Cancellation by Maintenance Etc
We may cancel or decline a service where:
-
it cannot safely be carried out;
-
the requested work is outside our competence;
-
the customer has provided materially inaccurate information;
-
access cannot be obtained;
-
the property presents an unacceptable risk;
-
payment for previous services remains substantially overdue;
-
the customer behaves abusively, threateningly or unlawfully towards our staff; or
-
circumstances outside our reasonable control prevent the service.
Where we cancel a service for reasons within our control and payment has already been made for services that have not been provided, we will provide any refund required by law.
19. Emergency and Urgent Situations
Maintenance Etc is not an emergency response service unless expressly agreed.
If you have an immediate risk to life, serious injury, fire, gas leak, serious flooding or another emergency, you should contact the appropriate emergency service or qualified professional.
20. Safeguarding
We take the safety and wellbeing of our customers seriously.
Where we have reasonable concerns about abuse, neglect, exploitation or another safeguarding issue, we may take appropriate action, including contacting relevant authorities where necessary.
We maintain safeguarding procedures for situations involving older or vulnerable customers.
Our safeguarding responsibilities do not make Maintenance Etc a regulated care provider unless we are separately authorised or registered as such.
21. Gifts, Money and Financial Matters
Employees and representatives of Maintenance Etc must maintain appropriate professional boundaries.
Customers should not ask employees to:

borrow or lend money;
-
access online banking;
-
use bank cards or PINs;
-
handle cash unrelated to the agreed service;
-
make personal purchases on their behalf; or
-
become involved in personal financial arrangements.
We may decline gifts where accepting them could create a conflict of interest or inappropriate relationship.
22. Photographs
We may take photographs of property or completed work where reasonably necessary for:

documenting a job;
-
preparing a quotation;
-
recording damage;
-
identifying a maintenance issue;
-
insurance purposes;
-
quality control; or
-
resolving a complaint.
We will handle photographs containing personal information in accordance with our Privacy Policy.
We will obtain appropriate permission before using identifiable customer photographs for marketing purposes.
23. Customer Reviews and Testimonials
We may invite customers to leave reviews about our services.
Customers are free to provide their genuine opinion.
We will not require customers to provide a positive review.
We will seek appropriate permission before publishing identifiable customer testimonials on our own website or marketing materials.
24. Privacy and Data Protection
We process personal information in accordance with applicable data protection legislation.
Our Privacy Policy explains:

our lawful bases;
-
who we may share information with;
-
how long we retain information;

security arrangements; and

25. Confidentiality

26. Website Information
We make reasonable efforts to keep our website accurate.
However, website information may change and should not be regarded as a contractual quotation unless expressly identified as such.
Prices, service availability, service areas and descriptions may be updated from time to time.
27. Third-Party Contractors
Where appropriate, Maintenance Etc may engage suitably competent third parties or specialist contractors.
Where another business is directly responsible for specialist work, that business may have its own terms, warranties, insurance and contractual arrangements.
We will make this clear where relevant.
28. Force Majeure
We will not be responsible for delay or failure to provide services caused by circumstances outside our reasonable control.
These may include:

flooding;
-
fire;
-
epidemic or pandemic;

industrial action;
-
road closures;
-
transport disruption;

power failures;
-
telecommunications failures;

supplier failures;

government action;

civil emergencies; or

We will take reasonable steps to minimise the effect of such circumstances.

30. Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
Subject to that, we will not be responsible for losses that could not reasonably have been anticipated when the contract was formed or losses arising solely from matters outside our reasonable control.
We will take reasonable care to avoid causing damage to customer property.
31. Intellectual Property
Unless otherwise stated, the content of the Maintenance Etc website, including text, branding, graphics, photographs and other materials, belongs to Maintenance Etc or its licensors.
You may view and use the website for personal and legitimate purposes.
You must not reproduce, modify, distribute or commercially exploit website content without appropriate permission.
32. Changes to These Terms
We may update these Terms & Conditions from time to time.
The current version will be published on our website.
Changes will not retrospectively alter contractual rights unless permitted by law.
Where an existing customer is affected by a material change, we will provide appropriate information.
33. Governing Law
These Terms & Conditions are governed by the law of England and Wales.
Where applicable, consumers retain any mandatory rights concerning jurisdiction and consumer protection.
